Elder Law & Medicaid Planning

This questionnaire is for families thinking about long-term care: Medicaid, nursing home and assisted living costs, care at home, and VA benefits. It works whether you are planning years ahead or facing a crisis this week. It takes about ten minutes, approximate figures are fine, and any question may be left blank.

Diagnoses if known (for example dementia, stroke, Parkinson's), recent hospitalizations, and what changed recently.

Children of the Person Needing Care

We need each child's date of birth and home address for the planning documents and the Medicaid application. Whether a child lives in the home and helps provide care can also matter legally, so tell us that too.

Monthly Income

Florida Medicaid has an income cap, and income over the cap can usually be solved with a Qualified Income Trust, so exact figures matter less than the overall picture.

Exempt Assets

Florida does not count certain assets toward the $2,000 limit. These questions tell us what is already protected.

Retirement Accounts & Annuities

In Florida, a retirement account that is in regular payout status is generally treated as an income stream rather than a countable asset, so how and how often withdrawals are taken matters more than the balance.

Countable Assets

These are the assets Medicaid counts toward the $2,000 limit. Checking a box does not mean the asset is lost; most can be lawfully repositioned or protected with the right design.

The Five-Year Lookback

Answering yes is common and is not a problem in itself; it simply tells us to look at timing before anything else is moved.
